일반적으로 교통위반이나 범죄 재판 전에 집행유예를 받는 것(PBJ)은 흔한 일입니다. PBJ에 동의한다는 것은 당신은 항소할 수 있는 권리를 포기하고 유죄를 인정한다는 것입니다. 그러나 유죄판정후에 PBJ 로 대체되는 경우도 있습니다. 여기서 당신이 알아야 할 세가지 사항에 대해 말씀드리겠습니다.
1) In
most circumstances, a PBJ can be expunged from your record after 3 years, which
means it will not show up in case search or in a background check. However, there are exceptions—such as
DUI—where expungement is not an option.
많은 경우PBJ 는 신원조회시에는 나타나지 않고 3년후에는 말소할 수도 있습니다. 그러나 음주음전의 경우 말소할 수 없는 경우도 있습니다.
2) One
question we get all the time is how to answer the question about convictions on
a job application when you have a PBJ on your record. The answer is that you can answer that
question “No” because a PBJ is not considered a conviction. In addition, if you were charged with DUI and
receive a PBJ, your insurance rates will not increase as dramatically as they
would if you were found guilty.
항상 받는 질문중 하나가 직장 인터뷰에서PBJ가 있냐고 물을때 대답은 “아니오”라고 답하셔야 합니다. 왜냐하면 PBJ는 유죄로 간주되지 않기 때문입니다. 게다가 당신이 만약 음주 운전으로PBJ를 받았다면 당신의 보험회사측에서는 음주운전사항을 가지고 보험료를 인상할 수도 없습니다.
3) Unfortunately,
not all crimes or traffic offenses are eligible for a PBJ. A first time DUI/DWI or controlled dangerous
substance crime is eligible for a PBJ. A
second DUI/DWI offense within a 10 year period or a second controlled dangerous
substance crime is not eligible for a PBJ.
Keep in mind, a PBJ is not awarded automatically just because you were
charged with a crime of traffic offense that is eligible for probation. For example, some judges will not award a PBJ
for DUI offenses, especially if there was a high blood alcohol concentration or
you contributed to an accident.
불행하게도 모든 범죄위반과 교통위반사항들이PBJ에 가능하지는 않습니다. 첫번째DUI/DWI 경우 PBJ가 가능합니다. 두번째DUI/DWI위반의 경우에는 10년안에 같은 유형의 범죄가 존재한다면 PBJ가 가능하지 않습니다. 기억하셔야 할 사항은 당신이 집행유예를 받을 자격이 교통위반의 범죄혐의로 기소되었다고 하여서 PBJ가 자동적으로 부여되는 것은 아닙니다. 예를들어 음주운전에 관해서 혈중알콜농도가 굉장히 높거나 교통사고와 연관이 있다면 PBJ를 부여받을 수 없습니다.
If you receive a PBJ
and violate the terms of your probation, i.e. getting charged with another
crime during your probationary period, you will face the entire sentence for
the crime or offense you committed when you are brought back in for the
violation of probation hearing.
